Chennai High Court Order: 2 helmets must be given by the vehicle manufacturer

A_building_in_ChennaiChennai High Court has ordered yesterday, Tuesday, 22nd September that the central government must immediately bring a regulation that all the 2-wheeler manufacturers should come forward to provide 2 quality helmets while selling their 2-wheeler.

 

 

The petition/case regarding helmet wearing came up for enquiry under Chennai High Court Judge N. Kirupaaran . The judge observed that the government has submitted a report on the implementation of wearing compulsory helmets. As per the report, 582 persons in June, 498 persons in July, 571 persons in August , 289 persons from 1st September till 15th September died  (since not wearing helmets). From the report, it appears that the order has been more strictly followed during the month of July only. After July, it has not been followed strictly.

The central government has sent details regarding the design and shape of the helmets. This must be submitted as a petition by the concerned authorities.

As per the Motor Vehicles Act 138-F, all 2-wheeler manufacturers have to give helmet along with the vehicle. Since it has been ordered that the pillion rider must also wear helmets, all vehicle manufacturers must be ordered to give 2 ISI quality marked helmets along with the vehicle.

This measure will help prevent the riders from using low quality helmets. Th central government must also order that the vehicle manufacture must provide the facility to lock the helmet in the 2-wheeler.

Government special advocate Mr. Venugopal requested to furnish the details regarding the deaths occurred due to failure to wear helmets not only from the government hospitals but also from the private hospitals. These details can be procured by the government from both government & private hospitals.

Judge Kirpukaran adjourned the case to be conducted on 30th October.

The judge also observed and recommended that videos regarding accidents/deaths because of failure to wear helmets can be shown to the drivers while issuing driving licenses to them.

If Political leaders and film celebrities involve themselves in creating awareness about wearing helmet, it will bring better results. Wearing compulsory helmet must become a ‘people’s movement’.
